Torres v. Verizon New York, Inc. and Empire City Subway, et al.

Thomas T. Papain of our New York City office obtained a dismissal of plaintiffs' Complaint and all cross-claims asserted against clients, Verizon New York, Inc. and Empire City Subway Company, Ltd.  The injured plaintiff, Torres, alleged that on February 4, 2012, she tripped and fell on a defect on the intersection of 3rd Avenue and Lincoln Avenue, Bronx, New York.  Plaintiff alleged that she suffered a closed fracture of her left patella requiring open reduction internal fixation due to her fall. 

The Court granted Mr. Papain's motion to dismiss the case and found that neither Verizon nor its subsidiary, Empire, worked at the location of plaintiff's alleged accident. (July 23, 2015)
