• ADM's William J. Mitchell Wins on Petition to Permanently Stay Arbitration

Our client's insured, a new car dealership, loaned an automobile to the claimant, who was involved in a collision shortly thereafter.  The claimant filed an intent to arbitrate against the dealer's commercial auto policy, without properly supporting the claim.  On behalf of our client, we filed a petition to permanently stay arbitration.  In a well-reasoned decision, Judge Wood of the Supreme Court, Westchester County, granted our petition to permanently stay arbitration.
