• Francis K. Liu and Samuel M Goffinet Obtained Summary Judgment in Snow & Ice Slip & Fall Case
Francis K. Liu, a Partner in ADM’s New Jersey Office and Samuel M Goffinet, of Counsel to ADM, obtained Summary Judgment in a slip and fall case allegedly caused by a dangerous condition, including snow and ice, that was in the parking lot. At the time of the accident, it was actively snowing and sleeting. Our client had salted the parking lot at 10:00 PM the night before, and again salted and plowed the lot on the morning of the accident.
Mr. Liu and Mr. Goffinet filed a Motion for Summary Judgment at the conclusion of discovery, arguing that the Plaintiff’s action must fail based on the ongoing storm doctrine. The Court ultimately granted the Motion on January 3, 2022 and dismissed the action against our client based on the ongoing storm doctrine, since the plaintiff could not establish either of the exceptions to the doctrine.
