Michael J. Rabus, a partner in ADM’s New York City office, recently obtained a defense verdict in Supreme Court, Kings County. The liability trial took 8 days to complete. The firm represented the employer of the Plaintiff involved in a construction site accident. The plaintiff was injured when he fell from a loading platform after a pipe rail that he leaned on collapsed. The rail was removable to allow for the unloading of delivery trucks onto the platform and into the hoist. Once a delivery was complete, the pipe rail was to be secured back into position by a locking mechanism. The jury found that our client did not create the dangerous condition but was otherwise negligent but that their negligence was not a proximate cause of the accident.
