Thomas Colameo, a partner in ADM’s New York City office, recently obtained a defense verdict in a trip-and-fall case venued in Kings County Supreme Court. The plaintiff claimed that she tripped over several protruding metal pipes on the sidewalk in front of our client’s property; our client maintained that the metal pipes were used to secure a gate at the time that was closed at the time of the plaintiff’s unwitnessed and uncorroborated accident. The jury deliberated for approximately 50 minutes and unanimously found that although our client was negligent, the client’s negligence was not a substantial factor in causing the accident.
