Kevin J. Murtagh, a partner in ADM's Albertson office, recently obtained a defense verdict in Westchester County in a case involving a barista (age 45) who was allegedly injured after she fell off a stepstool. Plaintiff claimed the stepstool was defective. She subsequently underwent right shoulder arthroscopic surgery for a torn labrum and two knee surgeries. She claimed a future knee replacement would be necessary. Plaintiff also claimed she could not return to work. Plaintiff's request for an instruction on punitive damages was denied. Following the jury's request for clarification on the charge of weighing the witnesses' conflicting testimony, the jury swiftly returned a verdict in favor of the defendant.
