Steven D. Zecca, of ADM's New York City office, recently obtained summary judgment in a case involving a nightclub assault in Brooklyn. The Plaintiff was shot in the leg by an unknown assailant in 2010. Our client leased the premises to a co-defendant who defaulted. Upon the completion of discovery Mr. Zecca filed a motion for summary judgment, arguing that our client was a true out-of-possession landlord, who transferred full possession and control of the premises to the co-defendant, and who did not have any dominion or control over the premises or the nightclub operation therefore our client owed no duty to the Plaintiff for criminal activity that occurred at the premises.
